1. Acknowledgement
This agreement is between you (“End User”) and Quouch UG (haftungsbeschränkt) (“Licensor”), not Apple Inc. (“Apple”). Quouch is solely responsible for the Quouch mobile application (“App”) and its content. Your use of the App must comply with the Apple Media Services Terms and Conditions.2. Scope of License
The App is licensed, not sold. You receive a limited, non-transferable, non-exclusive license to use the App on any Apple-branded device that you own or control, and as permitted by Apple’s Usage Rules, including via Family Sharing or volume purchasing.3. Maintenance and Support
Quouch UG (haftungsbeschränkt) is solely responsible for support and maintenance of the App. Apple has no obligation to provide support or maintenance services for the App.4. Warranty
Licensor is solely responsible for warranties. If the App fails to meet any warranty, you may notify Apple for a refund. Apple has no further warranty obligations. All claims arising from a failure of warranty are Quouch UG’s sole responsibility.5. Product Claims
Quouch UG (haftungsbeschränkt) is responsible for addressing any claims related to the App, including but not limited to: product liability, legal or regulatory compliance, and claims under consumer protection or privacy laws.6. Intellectual Property Rights
If a third party claims the App or your use of it infringes their intellectual property rights, Quouch UG (haftungsbeschränkt), not Apple, will handle the investigation, defense, and settlement of such claims.7. Legal Compliance
By using the App, you represent that:- You are not in a country under U.S. embargo or designated as supporting terrorism.
- You are not on any U.S. government list of prohibited or restricted parties.

9. Third-Party Terms
You must comply with all third-party agreements when using the App (e.g., wireless data agreements).10. Apple as Third-Party Beneficiary
You and Quouch UG (haftungsbeschränkt) acknowledge and agree that Apple and its subsidiaries are third-party beneficiaries of this EULA. Upon your acceptance of the terms, Apple shall have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary.
11. Subscriptions (In-App Purchases)
The App offers auto-renewing subscriptions:- Explorer, 12 months: €5.50 per month, billed €66 for the term
- Explorer, 6 months: €7.00 per month, billed €42 for the term
- Soli, 12 months only: €4.00 per month, billed €48 for the term (solidarity price, same access as Explorer)
Subscriptions renew automatically unless canceled at least 24 hours before the period ends. You can manage or cancel subscriptions in your App Store settings. Unused trial periods (if any) are forfeited upon subscription purchase.
12. User-Generated Content (UGC)
Users may post content in the App. By submitting content, you agree that:- You retain ownership of your content.
- You grant Quouch UG a royalty-free, worldwide license to use it solely to operate or improve the App.
- You are responsible for the legality of your content.
- You will not post illegal, offensive, or infringing material.
- Quouch may moderate or remove content at its discretion.
13. Reporting Content
To report abusive or inappropriate content, use the in-app Report button or contact hello@quouch-app.com.14. Privacy and Terms
By using the App, you agree to:15. Limitation of Liability
To the extent permitted by law, Quouch UG is not liable for indirect or consequential damages. Total liability is limited to €50.00. Your statutory consumer rights remain unaffected.16. Termination
This agreement is effective until terminated by either party. You may terminate by deleting the App. We may terminate if you breach any term of this EULA.17. Governing Law
- If you are located in the EU, Switzerland, Norway, or Iceland, this EULA is governed by the laws of your country of residence.
- If you are in the U.S., California law applies and disputes must be brought in courts in Santa Clara County, California.
